Baggage Issues: Your Rights and How We Can Help

What Governs Passenger Rights?

Passenger rights regarding lost, delayed, or damaged baggage are protected under:

  • The Montreal Convention

  • EU Regulation No. 2027/97, which supplements the Convention

Delayed Baggage

  • Baggage is considered delayed if it does not arrive with you but is delivered within 21 days.

  • If it has not arrived within 21 days, it is classified as lost.

  • You may be entitled to reimbursement for essential purchases (e.g., clothing, hygiene items) caused by the delay.

Lost Baggage

  • If an airline acknowledges your baggage as lost or it has not arrived within the 21-day period, you have the right to claim compensation.

  • The maximum compensation amount is up to €1,920 (as of October 2024).

  • To file a claim, you’ll need to:

    • Submit it within 21 days of arrival.

    • Provide relevant documentation: flight tickets, baggage receipts, and purchase invoices.

Damaged Baggage

  • Any damage must be reported within 7 days of receiving your baggage.

  • The airline must cover the cost of the damaged suitcase and its contents.

  • Normal wear and tear (scratches, scuffs) is not covered.

Mobility Equipment

  • Damage to mobility aids such as wheelchairs is also covered, and compensation may exceed standard limits.

Compensation under the Montreal Convention

  • Maximum compensation: up to €1,920

  • Based on the actual losses: value of items, baggage, and mobility devices

  • Requires supporting evidence such as receipts, photos, and itemized lists
